These Terms of Service (“Terms”) govern your access to and use of the website furnishup.ai and any services provided by Furnishup.Inc (“FurnishUp,” “we,” “us,” or “our”). By using the Service, you agree to be bound by these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. The Service

FurnishUp provides software that helps you design and furnish your home, including AI-generated design recommendations and shopping integrations with retail partners. The Service is provided “as-is” and may change, suspend, or terminate features at any time.

4. Purchases

When you purchase products through the Service, your transaction is fulfilled by our retail partners and is subject to their terms of sale, returns, warranties, and shipping policies. FurnishUp is not the seller of record unless explicitly stated.

5. User content

You retain ownership of any content you submit (such as room photos, dimensions, or preferences). You grant FurnishUp a worldwide, non-exclusive, royalty-free license to use that content to operate, improve, and provide the Service.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose;
• Attempt to access another user’s account or any non-public area of the Service;
• Reverse engineer, scrape, or interfere with the Service;
• Upload malicious code or content that infringes the rights of others.

7. Intellectual property

The Service, including all software, designs, text, graphics, and trademarks, is owned by FurnishUp or its licensors and is protected by intellectual property laws.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FurnishUp does not warrant that design recommendations will meet your expectations or that the Service will be uninterrupted or error-free.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FURNISHUP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FURNISHUP IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) US $100.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
